										<content:encoded><![CDATA[<p class="">Robbie Knievel, the youngest son of the late daredevil Evel Knievel, was charged with felony drunken driving and criminal endangerment after allegedly causing a multi-vehicle collision in Butte Montana on Tuesday night.</p>
<p class="">According to Butte police, Knievel was driving a 2005 GMC Yukon at a high speed heading south on Harrison Avenue. Witnesses told police he rear-ended a Honda Accord, it hit a Ford Taurus and the Ford struck a Hummer.<img loading="lazy" class="alignright size-full wp-image-502" src="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2015/04/aaarobbie.jpg?resize=231%2C350" alt="aaarobbie" width="231" height="350" srcset="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2015/04/aaarobbie.jpg?w=231&amp;ssl=1 231w, https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2015/04/aaarobbie.jpg?resize=198%2C300&amp;ssl=1 198w" sizes="(max-width: 231px) 100vw, 231px" data-recalc-dims="1" /></p>
<p class="">Knievel fled the scene in the GMC and it was located shortly afterwards parked on Sanders Street two blocks away. Police then saw Knievel walking on Busch Street, a block from the accident scene, and stopped him.</p>
<p class="">He had a bloody lip and police smelled alcohol on his breath. He admitted he had been driving, police said.</p>
<p class="">He refused to take a Breathalyzer and could not take some of the field-sobriety tests because of his bloody lip, police said, so they got a search warrant and had a blood sample taken at St. James Healthcare.</p>
<p class="">Police said his address is in Sequim, Washington, but the GMC he was driving Tuesday night was registered to a Butte man. When the judge asked Knievel to state his address, he paused for several seconds and said it was on his driver’s license.</p>
<p class="">Knievel, 52, caught a pretty good break considering the multiple DWI convictions: in lieu of bond being set, he agreed to either come to the jail each morning and evening and submit to alcohol screening or wear a bracelet that detects alcohol.</p>
<p class="">This DWI is a felony because Knievel has three previous convictions. The additional charge of felony criminal endangerment charge stems from Knievel allegedly running a red light and causing an accident that created substantial risk of death or serious bodily injury to another.</p>
<p class="">None of those others involved in the wreck appeared to suffer injuries.</p>
<p class="">Knievel also caught 3 misdemeanor cases: (1)leaving the scene of an accident, (2) operating a motor vehicle without an interlock device and (3) running a red light.  Thats right, he was supposed to be driving with an interlock breathalyzer aparatus from his LAST DWI conviction.</p>
<p class="">The drunken driving charge carries a maximum five-year sentence and $50,000 fine and the criminal endangerment charge carries a maximum 10-year sentence and $50,000 fine.</p>
<p class="">The three misdemeanors carry possible six-month jail sentences and fines ranging from $200 to $500.</p>
<p>Knievel was cited for felony DUI and was booked into the detention center.</p>
<p class="">The Honda Accord and Ford Taurus had to be towed from the scene, but the Hummer was able to drive off.</p>
<p>Knievel pleaded guilty to DUI in South Dakota in August 2013. He had been arrested in Lawrence County after the vehicle he was driving crashed into two motorhomes while he was leaving the Buffalo Chip Campground.</p>
<p class="">His preliminary blood-alcohol breath test that night measured 0.228 – almost three times the legal limit.</p>
<p class="">He received a suspended jail sentence and paid nearly $600 in fines and his driver’s license was suspended for 30 days.</p>
<p class="">Knievel called into “TMZ Live” radio talk show after his 2013 arrest and admitted he was drunk that day, saying “I’m a frickin’ drinking, driving daredevil.”</p>
<p class="">“I ride motorcycles and I friggn’ drink and ride … that’s my deal,” he said.</p>
<p class="">He said he had an alcohol problem.</p>
<p class="">“I’m a cowboy. I’m not a redneck. But I love whiskey,” he said.</p>

<p>Police say Glushko drove off a road in a pickup and crashed into pipe stacked in a company yard.  The pickup was left straddling pipe.</p>
<p>Unphased, Glushko then meandered over to nearby George Horner Ice Park, stole a forklift and drove off with it.</p>
<p>Glushko then allegedly drove the forklift down Phillips Field Road past the crash scene, to Illinois Street, Soden said. An Alaska Railroad worker told police he saw a man drive the forklift to Illinois Street. The worker told police Glushko said he was taking the forklift to get his dad’s truck, which had a flat tire.</p>

<p>Glushko then apparently turned back to the west where police at the scene of the truck crash spotted him.</p>

<p>“Police were on scene talking to the railroad worker when Mr. Glushko came driving back up on the forklift,” Soden said.</p>

<p>Glushko was cooperative and agreed to take a breath-alcohol test, Soden said. It registered 0.230, almost three times the intoxication standard of 0.08.  Police were at the scene when Glushko looped back.</p>
</div>
<p>Glushko has been charged with felony driving under the influence of alcohol.  He remained jailed Tuesday.</p>

<p>The incident is being investigated by Homeland Security, and the two agents have been reassigned to nonsupervisory positions.</p>
<p>Officials have of course voiced concerns that the men being investigated are &#8220;regularly within arm&#8217;s length of the president.&#8221;</p>
<p>What is going on here&#8230;are these guys not supposed to be members of our elite service?  Although I will wait to pass judgment until they are found guilty, the possible implications are troubling.</p>
<p>Congressman have acted, and have stated that they are inquiring as to whether the agents were intoxicated, whether a sobriety test was ordered by those who responded to the accident, and if so whether that test was administered.</p>
<p>&#8220;If anyone requested that and it did not happen, I&#8217;ve got a big problem with that,&#8221; said Representative Chaffetz of Utah, Chief of the House Oversight and Government Reform Committee;  &#8220;If somebody was indeed suspected of being under the influence, that should have been dealt with right there on the spot, and I&#8217;m concerned that it wasn&#8217;t.&#8221;</p>
<p>Chaffetz, who has been loudly critical of apparent lapses and misconduct in the ranks of the Secret Service, reiterated Wednesday that healing the troubled agency will require more than a few simple personnel changes. How this incident is handled, he said, will serve as a test for the service&#8217;s new director, Joseph Clancy.</p>
<p>&#8220;We&#8217;re going to find out real quick what sort of discipline is (Clancy) going to institute there,&#8221; Chaffetz said. &#8220;If this is true, he had better deal with it swiftly. This is totally unacceptable.&#8221;</p>

<p><strong>The scheme<br />
</strong></p>
<p>Police officers report finding the two tipsy men at an icy intersection in the middle of the night. Zambenedetti left little doubt about his state of mind when he was found shirtless in the driver&#8217;s seat of his car.  Weather reports indicate the outdoor air temperature was hovering around 1 degree.</p>
<p>The evidence?  Two 5-gallon buckets in their car; the buckets still had some water in them, police say.</p>
<p>Officers allege Byers coasted through a stop sign at the same intersection, collided with a guard rail, and drove the car back to his house.  When there, he recruited a co-pilot and devised the scheme to cover up the wreck.</p>
<p>Police further allege the men had created enough ice in the intersection to require half a ton of salt to melt. Sounds like they used quite a few buckets!</p>
<p><strong>The charges<br />
</strong></p>
<p>Byers was charged with failure to stop at a stop sign, careless driving, driving while intoxicated, failure to report an accident, leaving the scene of an accident, and disorderly conduct (for intentionally icing the intersection).</p>
<p>The problem will be what defense attorneys call &#8220;wheeling the driver.&#8221;  They must put him behind the wheel through presentation of some evidence.  Bryer has denied operating his car, as has Zambenedetti.   However, Zambebedetti has also been charged with careless driving, driving while intoxicated (no breath or blood tests, just field sobriety excercises), and failure to wear a seat belt.</p>
<p>They could have been charged with more.  In New Jersey it is illegal to use any object or &#8220;other thing of physical substance knowing it to be false and with purpose to mislead a public servant who is engaged in [an] investigation.&#8221; Tampering with evidence is a fourth degree crime carrying a possible 18-month jail sentence.</p>
<p>The takeaway?  If no one is there to witness an accident and no one else is involved &#8211; might want to think twice about trying to cover up the incident.  Perhaps Byers should have just stayed at home, police may never have found out.</p>

<p>Any kid worth his salt can tell you that Vanilla Extract packs an alcoholic punch. In fact, it contains 41 percent alcohol, like most hard liquors like vodka, tequila, whiskey or gin.  Interestingly, to be labeled as pure vanilla extract, it has to have at least 35% alcohol.</p>
<p>In order to dissolve vanilla&#8217;s essential oils, the concentration must be that high.  When you cook the vanilla most of the alcohol is cooked out of it (thats why vanilla pastries don&#8217;t get you sloshed).</p>
<p><strong>What&#8217;s a desperate alcoholic drunk off vanilla to do?</strong></p>
<p>I suppose she could try to claim the defense of involuntary intoxication &#8211; but that requires she prove that she drank something that he or she didn&#8217;t know was intoxicating? Not likely to work.  This defense usually only works when someone&#8217;s drink is adulterated without their knowledge.  Difficult to imagine consuming two &#8220;hand-sized&#8221; bottles of vanilla extract not knowing that each bottle was 41 percent alcohol.</p>

<p>Desormes would have been only charged with misdemeanor DWI, but his attempt to chew up the evidence from the breath test led to an additional charge of obstructing governmental administration, and criminal tampering.  The initial arrest for the DWI was prompted by officer <a href="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/11/eating-paper.jpg"><img loading="lazy" class="alignright wp-image-395 size-full" src="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/11/eating-paper.jpg?resize=400%2C224" alt="eating paper" width="400" height="224" srcset="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/11/eating-paper.jpg?w=400&amp;ssl=1 400w, https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/11/eating-paper.jpg?resize=300%2C168&amp;ssl=1 300w" sizes="(max-width: 400px) 100vw, 400px" data-recalc-dims="1" /></a>observations.  In Texas, the requisite probable cause determination by officers requires articulable evidence that someone has lost the normal use of his mental or physical faculties due to the introduction of alcohol.  The officers requested that Desmormes take a Breathalyzer test, which indicated he had a 0.13 percent blood alcohol content (BAC).</p>
<p>His motivations are unclear, but one can infer that Desormes was not happy with his test results, and Desormes allegedly tried to snatch the results from the printer and eat them. Impeding a police investigation can get you an obstruction of justice charge, and Desormes, although creative in his appetite to mitigating the incriminating test results, is no exception. The obstruction charge is a Class A Misdemeanor, punishable by up to a year in Jail.</p>
<p>In addition, Desormes was charged with criminal tampering.In New York, a conviction on this charge  may add another three months to his potential sentence.</p>
<p><strong>An Appetite to Get Away with It!<br />
</strong></p>
<p>Believe it or not, Desormes he&#8217;s not the only one to try to eat incriminating evidence.  As many poeople may be aware (and perhaps personally aquainted with), one way that those suspected of possessing drugs dispose of the contraband is to eat it.  The success rate may not seem too high, but then again, how would we know who were the ones that had got away with it?</p>
<p>A notable recent case that gained national attention was when Florida Crime Stoppers director Richard Masten was placed in contempt of court for refusing to reveal information related to a tipster &#8230; by eating a piece of paper in open court in front of the Judge.</p>

Since January, six firefighters have been suspended for being arrested for suspicion of DWI.  The latest suspect was one of the brass, on July 11, Madison, a 29-year AFD veteran who receives the highest salary of any AFD firefighter, was &#8220;suspended indefinitely&#8221; after crashing his car in North Austin the evening of May 10.</p>
<p>Police reported they smelled alcohol on Madison&#8217;s breath and that he&#8217;d stumbled, mumbled, and nearly fell down. He told authorities he&#8217;d consumed &#8220;a few&#8221; drinks that evening. In a May 30 interview with members of the Professional Standards Office, Madison admitted to actually having more than a few, more like between 10 and 12 drinks.</p>
<p>Austin Fire Department Chief Rhoda Kerr&#8217;s action against Madison marked a turning point, punishments finally have been getting more steep after being slaps on the wrists to date.</p>
<p>A pattern may be emerging, as Madison is the sixth firefighter suspended for a DWI since January of 2013.  He is, however, the first to incur a be punished with more than a 90 day suspension.  Even the 90 day suspension is rare as punishment, and only was doled out to firefighter James Doyle, who was facing his third DWI charge since 2006.  Doyle agreed to alcohol counseling, randomized testing, and a one-year probation period, as well as assuming the understanding that another violation would result in an indefinite suspension.</p>
<p>Otherwise, Kerr has mostly issued a series of suspensions stretching between 10 and 15 days.  This  despite firefighters reportedly admitting driving after consuming upwards of 10 alcoholic beverages in a sitting.</p>
<p><img loading="lazy" class="alignleft size-medium wp-image-320" src="https://i0.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/08/pols_feature32-225x300.jpg?resize=225%2C300" alt="pols_feature32" width="225" height="300" srcset="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/08/pols_feature32.jpg?resize=225%2C300&amp;ssl=1 225w, https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/08/pols_feature32.jpg?w=250&amp;ssl=1 250w" sizes="(max-width: 225px) 100vw, 225px" data-recalc-dims="1" />Madison&#8217;s suspension is the second DWI-related sanction handed down to members of the AFD since Kerr&#8217;s November 2013 memorandum informing her staff that &#8220;prior efforts, including temporary suspensions of 10 days, were not having their intended and desired effects, to wit, to curtail alcohol abuse by Department Personnel, particularly driving while intoxicated.&#8221; In the memo – apparently distributed by Kerr because 38% of the AFD suspensions mandated between Feb. 1, 2009, and Oct. 4, 2013, had been DWI-related – Kerr went on to explain that &#8220;future first-time &#8216;driving while intoxicated&#8217; violations would result in a disciplinary action, up to and including indefinite suspension.&#8221; Madison reportedly acknowledged receipt of this memorandum – but still decided to drive drunk.</p>
<p>Kerr&#8217;s explanation does not mention of the 60-day suspension levied on firefighter Randlall Black.  Black was stopped for speeding on I-35 and subsequently arrested for DWI – though in her initial memorandum sent out to the department, Kerr wrote that &#8220;every alcohol related discipline case involving sworn and non-sworn will be judged on its own merits.</p>
<p>&#8220;I will decide the appropriate disciplinary action, which may include days off up to and including the indefinite suspension/termination of the employee.&#8221;</p>
<p>How Chief Kerr differentiates between what requires 60 day suspension and what an indefinite suspension is unclear, though a comparison of the two memos suggests that Madison – who could barely stand, and had crashed his car so hard into a guard rail that he broke his front right axle – was significantly more blitzed than Black, whose rap sheet in this instance entails little more than &#8220;a strong odor of an alcoholic beverage&#8221; on his breath.</p>
<p>Kerr&#8217;s appears to be addressing a pretty widespread problem, for AFD. It also may indicate a crackdown by Aus­tin Police Department Chief Acevedo. In early April, Acevedo distributed a dramatic video to departmental personnel (copying local media) announcing a new, zero-tolerance policy against drunk-driving police officers. First-time offenders won&#8217;t just receive temporary suspensions anymore, Acevedo asserted. Each suspected offender stands to be fired, whether or not they&#8217;re found guilty in a court of law.</p>
<p>With news stories of the police beating, choking and shooting people &#8211; maybe Austin FD poses a different hazard to the public, on our roads.  They are all of course innocent until proven guilty, but the pattern is real.  It seems like many firefighters in Austin are partying quite a bit.</p>

<p>from his cooperation in the police investigations against detective Anthony Nelson, who Brand said was untruthful on the stand during a murder trial in January.</p>
<p>Lehmberg has declined comment on the allegations. The Lawsuit Brand filed is a whistleblower complaint, claiming Lehmberg asked Brand to downplay false testimony Nelson gave in the trial of Darius Lovings, a man convicted of killing a motorist who authorities said tried to help Lovings when Loving pretended to have car trouble.  Nelson told prosecutors that he had lost control of the crime scene that night and asked that they keep it “just between us,” according to the complaint.</p>
<p>Brand reported the statement to Lovings’ lawyer, Jon Evans, considering it evidence favorable to the defense and therefore that he was legally bound to divulge.  On the witness stand in trial, Nelson admitted he lost control of the scene but denied “having asked Brand to keep the admission ‘between us,’” according to the documents.</p>
<p>Brand alleges Lehmberg told him multiple times that the incident — which led police to initiate two separate internal investigations — had been “blown out of proportion.”  In a statement, the Texas Department of Public Safety said, “The Austin Police Department did contact the Texas Rangers, who conducted an inquiry related to the Travis County district attorney’s office in early April to determine if a full investigation was warranted. The Rangers determined further investigation was not warranted and that a criminal offense had not been committed. The inquiry was then closed.”</p>
<p>Brand’s lawyer, Tom Nesbitt, claims his client was wrongfully terminated.  “He cooperated in a police investigation,” Nesbitt said. “He resisted Rosemary Lehmberg’s attempt to influence what he would say in that investigation, and he was retaliated against.”</p>
<p>This is a glaring example of the culture of lying, dishonesty and cover-ups that unfortunately has overtaken the District Attorneys office in <img loading="lazy" class="alignright size-large wp-image-289" src="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/041913-Rosemary-Lehmberg-MUG-819x1024.jpg?resize=590%2C737" alt="041913-Rosemary-Lehmberg-MUG" width="590" height="737" srcset="https://i0.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/041913-Rosemary-Lehmberg-MUG.jpg?resize=819%2C1024&amp;ssl=1 819w, https://i0.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/041913-Rosemary-Lehmberg-MUG.jpg?resize=240%2C300&amp;ssl=1 240w, https://i0.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/041913-Rosemary-Lehmberg-MUG.jpg?w=960&amp;ssl=1 960w" sizes="(max-width: 590px) 100vw, 590px" data-recalc-dims="1" />Travis County under the direction of DA Lehmberg.  This was not just a simple mistake.  False testimony by an officer never is.  It certainly is not “no big deal.”  Reports state that DA Lehmberg has said Brand&#8217;s termination was because he doesn’t share her values.   With this lawsuit, I predict that we will uncoverjust what are Rosemary Lehmberg’s values, and it will not be pretty.</p>

										<content:encoded><![CDATA[<p>The small suburb of San Antonio got himself in a bit of a bind last month for driving drunk; he resigned following the DWI arrest while he was driving his patrol car.  China Grove Police Chief Larry Davis was driving his marked police vehicle on the way back from law enforcement training in Huntsville when he was stopped by Temple Police Officers.</p>
<p>Davis tendered his resignation in a letter dated the same day as his arrest. The resignation became public July 3 when it was accepted by the<a href="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/Drunk-Cop.jpg"><img loading="lazy" class="alignright size-full wp-image-276" src="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/Drunk-Cop.jpg?resize=494%2C377" alt="Drunk Cop" width="494" height="377" srcset="https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/Drunk-Cop.jpg?w=494&amp;ssl=1 494w, https://i2.wp.com/legas.legrandelaw.com/wp-content/uploads/2014/07/Drunk-Cop.jpg?resize=300%2C228&amp;ssl=1 300w" sizes="(max-width: 494px) 100vw, 494px" data-recalc-dims="1" /></a> City Council at its regular monthly meeting.</p>
<p>The letter gave no reason for his departure and no reason was given at the meeting. Davis did not attend the meeting and has not returned multiple phone calls.</p>
<p>The city-issued Tahoe driven by Davis at the time of his arrest was released to Jenkins, who traveled to Temple to pick it up, the Temple police spokesman said.</p>
<p>China Grove&#8217;s council has shut down and revived the city police department several times since December 2013, complaining about a backlog of hundreds of un-served warrants. Davis had repeatedly asked for more officers to handle the backlog.</p>
<p>Sounds like another instance of an officer thinking he is above the law.  I am trying to think just how badly he must have been driving in his patrol car for him to be pulled over on suspicion of a DWI.  I also wonder about his charges, did he actually submit to breath or blood tests?  How about field sobriety tests.  He needs a good lawyer for sure!</p>

<p>It reminds me of the scene from the beginning of the Longest Yard with Adam Sandler&#8230;except Goodman came out better than Sandler did &#8211; he was sentenced to 364 days work-release jail (jail on the weekends).  His blood alcohol was &gt;16, double the legal limit.</p>
<p>I got to hand it to his attorneys, they argued what I always do when trying to get my client work-release jail: the Defendant has a job that people depend on him, and his family depends on his support, so says his attorney &#8220;It gives them means to support themselves, their families, and in Mr. Goodman&#8217;s case, because he&#8217;s an employer, employees keep their jobs.&#8221;</p>

<p>In Texas, by the time you pick up your 3rd DWI you are looking at a 3rd degree felony, punishable by 2 to 10 years in prison and a $10,000 fine.  Any subsequent lockups for DWI would make you eligible to be charged as a habitual offender, and could enhance the punishment up to a 2nd degree felony, which is punishable by 2 to 20 years in jail and a $10,000 fine.  Get another one&#8230;like a 5th, 6th or 7th DWI?  You could be enhanced yet again, being sentenced as a 1st degree felony, punishable by 5 to 99 years in jail!</p>
<p>If you want to find out what happens when someone is sentenced on their 7th DWI in Texas, just type it in google and see what comes up.  You will see DECADES of jail time handed out to those convicted that are in the position of this Goodman clown.</p>
<p>Goodman availed himself of a provision in the Washington Penal Code requiring 4 DWI&#8217;s to be accumulated in a 10 year span for the most recent to be charged as a felony.  We used to have recency requirements on our DWI&#8217;s in Texas &#8211; but not anymore, they tally up here no matter how far apart they occur.</p>
